Patents and Trademarks

What are Patents and Trademarks?

patent is a government license that gives the holder exclusive rights to a process, design, or new invention for a designated period of time.  In the U.S. granting a patent means “to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States” for a limited time.

trademark is a word, name, symbol or device which is used in trade with goods to indicate the source of the goods and to distinguish them from the goods of others.  Trademark rights may be used to prevent others from using a confusingly similar mark, but not to prevent others from making the same goods or from selling the same goods or services under a clearly different mark.

Regulations and Standards

What are standards?

Standards are published documents created to ensure the reliability of the materials, products, methods, and/or services.  They establish requirements, specifications, guidelines, characteristics, and/or procedures designed. Typically, they are developed through a consensus process and approved by various national and international agencies, professional societies, or industry organizations. Standards are the minimally accepted professional practice and/or quality that must be observed.

The EWU libraries may not have access to the standards that you need. However, what I suggest is that you use the WorldCat Catalog once you find your standard and then place an Interlibrary Loan request for it. Or you may contact me directly and I can see what I can do to get you access.

What are Regulations and Codes?

A regulation is a type of standard that has been mandated by law. Regulations specify legally obligated requirements that must be met under specific laws and implement general agency objectives. Occupational Safety and Health Administration (OSHA) Regulations are an example of this type of standard.
